Především podporujeme děti se vzdělávacím znevýhodněním. Vydáváme odborná stanoviska, připomínkujeme zákony a předkládáme návrhy legislativních změn. Spolupracujeme s politiky a dalšími rozhodujícími činiteli na změnách v českém vzdělávacím systému. Pracujeme na tom, aby se české školství posouvalo směrem k větší otevřenosti vůči lidem s potřebou vzdělávací podpory.

Podle našeho návrhu by měla být ve vyhlášce o základním vzdělávání vypuštěna možnost ředitelů ZŠ stanovit si „kritéria pro přijímání žáků“, která není v souladu se školským zákonem.

Ani tato kritéria však nesmí nijak hodnotit kvalitu, výkon ani vzdělávací předpoklady dítěte, protože pak by byly v rozporu s mezinárodněprávními standardy, podle kterých je základní vzdělání určeno všem a není podmíněno žádnými schopnostmi dětí, včetně ochrany před diskriminací.

MŠMT a ŠPZ mají rodiče jednoznačně informovat o tom, že názor ŠPZ ohledně druhu školy, ve které by se dítě mělo vzdělávat (běžná/ speciální), je pouze doporučením a není pro rodiče nijak závazný. Jediný, kdo rozhoduje o volbě školy, je rodič, resp. zákonný zástupce dítěte podáním přihlášky do konkrétní školy. Spádová škola pak dítě starší 6 let musí přijmout.

Všechny děti mají ze zákona nárok na podporu při vzdělávání, kterou potřebují. A to bez ohledu na druh školy, kde jsou vzdělávány.

Proto usilujeme o to, aby bylo zrušeno protizákonné omezení poskytování podpůrných opatření (včetně asistenta pedagoga) ve speciálním školství od ledna 2020. Novela vyhlášky č. 27/2016 Sb. je v této části v rozporu se školským zákonem, který garantuje podporu všem dětem bez ohledu na druh školy, a jedná se tak o protizákonnou praxi, které se věnuje i Kancelář veřejného ochránce práv.
